There is an interesting article on the net about the couple that was arrested last week on child porn charges for running a child modeling site.   There was a lengthy thread here on MM, but it was all based on very limited information on what happened and the ramificationis.

This post is neutral, I am not taking sides on the issue because it is obvious that it isn't very clear cut from the perspective of either side.  Personally, I don't have enough information to make a judgement.

I just thought I would post the link because it offered a lot of food for thought as to what are industry is facing.

"In 2002, Rep. Mark Foley announced a bill called the Child Modeling Exploitation Prevention Act that would effectively ban the sale of photographs of minors. But under opposition from civil libertarians and commercial stock photo houses like Corbis, it never left committee. (Foley, of course, is the same politician who resigned in September after disclosures of inappropriate conversations with a teenage page.)"

You sport photographers watch out! Don't take any pictures of gymnasts doing their stunts, especially floor exercises.

Watchout for ice skaters as well. Taking a picture of a skater performng a spiral could land you in jail!

Oh, yeah, and bicyclists wearing nthose slinky little spandex shorts . . .

What a bunch of crap.

Dont forget cheerleaders, runners and vacation shots at the beach.  God forbid any of us are doing prom shots anymore.

Thanks, Alan.  I think most people don't like these child modeling sites at least the
ones the men charged ran or produced images for but as some have said,
whats next?  Could a photographer chance being arrested for taking photos of
under aged models at public events if the models are in swimsuits or perhaps shooting a sporting event.  Maybe its a photo of one of your children in a playful
pose or even a model who looks under 18.  The photographers are in serious trouble because several years ago a photographer who shot young girls outside
but focused on their crotch area was found guilty of child porn.

Nothing covered by law should be left as emphemeral as the laws on child pornography. I think those laws should be amended to state specifically what is child pornography. Perhaps it should say that taking pictures of an underaged model that displays genitalia or areoli either through nudity or transparent clothing would be pornographic.

There need to be some graphic line in the sand, clearly defined, that one can't legally cross.

The UK did it... and now the US is doing it... "creating," virtually out of thin air, thousands of more "paedophiles" in the legal sense that the medical/psychiatric professionals would never classify that way - not by catching the real ones that actually abuse children, - but by redefining what a paedophile is and repeatedly lowering the bar to catch even more of the perceived thousands they couldn't tag before.

The medical/psychiatric community can not treat them successfully because they are not paedophiles in the first place. For the politicians, however, it is a self fulfilling legislative fantasy... that there are millions of paedophiles out there... and all they have to do is change the law to be able to catch them.
