For the second time ever, incidentally both times with the same model, I have  been falsely accused of selling images to an adult site.  I have never sold any of his images to anyone.  As a matter of fact I took down all of his images after the first accusation many months ago.  I do have a full model's release signed by him that allows me to do whatever I want with the pictures.

The last time he pulled this he refused to give me the information on the site that was allegedly using the pictures.  This time he has not provided me with any info, again.

To fully understand this you need to know that he was twice posed for a gay male foot fetish site.  He was paid for both of those jobs.  His work with me was TFCD and he even asked if he could come back for a second shoot, for which I obliged him.

I am aggravated by this and would love to hear your take on it.

Text of his E-mail to me:

"Jeff,

I have removed your pictures from my sites. If I find you posting my pictures, and my name, again on sites that can hurt my reputation (i.e homosexual, porn, etc), I will take legal action.

This has happened twice now. I have people looking to see what else you've put up. If there is anything else, I suggest you remove it before they find it.

(Is there any reason for me not to use his name?)

I got accused once by a model I had shot with. However, I never even shot her nude to begin with. Some people... Go figure!

The only thing you can really do is explain to the man that if his photos are on the internets, ANYONE can take them and will hoping to not get caught.  And then explain AGAIN that you did not sell them.

Dear Regretfully,

I have not posted your photos on a gay site, nor have I defamed you in any way. Furthermore, may I remind you that you signed a full model release and that you are bound by its terms. Should I publish your photos anywhere, I will have the legal right to do so.

Should you make the regretable mistake of filing a lawsuit, which given the terms of the model release, could only be regarded as frivolous, I will file a counter claim. In that action, I will seek damages, attorney's fees and court costs.

Sounds like hate speech.  I'd forward his contact info and photo to a gay action group. wink


In reality though he has a lot of "proving" to do if he wants to take anything down the road of lawsuits.

After the first shoot he was all "buddy, buddy".  I had no reason not to shoot him a second time.
This nonsense all happened later.

No.  Porn sites don't want my photographs.  I did sell some to Nerve.Com a couple times though.

I just heard back from the model with the "evidence" that implicates me in this.  I copied and pasted the correspondence from the website owner that he states names me as the provider of the images, below.

The following is an excerpt from the letter the model wrote to accompany the above.  There is not one word of truth in it.  Unless someone else is posting to gay boards in my name, which is damn unlikely, he is totally delusional.

"You basically get your jollies off watching young men in as little clothing as possible....that's almost a direct quote from YOU on one of the gay web sites you have a personal ad posted. I about vomited when I saw it....literally. The rage that I felt at that moment was almost more than I could contain. I have NEVER felt so violated in my life. I suggest you think about that and do some soul searching."

I have never even read a gay bulletin board, no less posted to one, but it may not be not a bad idea to find clients. haha  It does kind of make you wonder why he is looking there.
