He is gone.  We don't allow sluggos, and obviously he has no idea how to be an agent or act as an agent.

Never ceases to amaze me how these "agents" go to an internet website to figure out how the industry works.  Ick.

BTW, it was a "he", not a "she".

Nobody asked....was this a paid shoot or a TFP ?
was this for commercial use ?
exactly what does "your" model release say ?
what does your agreeement with the model as an agent say ?

I am the Agent and he is not a commercial photographer. How can I get that put in my Contract with the Model?

Your contract with the model does not affect the photographer, nor does it give you any right to the images he creates. When a photographer snaps the shutter, the image created is his intellectual property, that he may license to you  or the model if he receives compensation. The terms of that license are negotiable, however most pros will not give up their copyright unless you bring a rather large check. You don't need copyright ... just rights to use the image.

You pay for "use" of the images. Buy only what you need, no more. If you need rights to the images to use promoting the models and your agency, figure out how you intend to use the images and negotiate to purchase only that limited use.

In TFP/CD situations, the photographer will usually provide only the images he approves for public viewing (after all, his image is at stake) ... and will give only an amount of images equal to fair exchange for the model's time. If a photographer's shooting rate is $150 hr ... and he spends three hours shooting ... and his license fee for promotional use is normally $30 per image, then don't expect dozens of images in exchange for three hours of model's time which might be valued anywhere from $20-100 hr. If your models are top-notch experienced pros ... rates could be higher, of course.

It's all negotiable ... but you need to instruct your models to contract with the photographer ... or you'll need to do it for them. You'll find that many photographers have different business models they follow, so each contract may vary greatly and any "boilerplate" contract you attempt to send out with the model may work against you if you're not flexible.

Cheers,
Jimmy

OK i am also new to photography and still have a lot to learn, your first problem is your acting as an agent, and you seem to have no idea what your doing. your second problem is, your trying to manage 5 girls, and your screwing them over too and my guess is harassing the photographer. next problem, if I'm reading all this right that is, you have a contract with all the girls right? but you have to have a contract with the photographer, you can hold him to the contract he signed, but not the contract you made the girls sign. Also, your buddy at the computer store wont cut it when you in court trying to get your photos and you say "My friend told me that this is how you do it" go to a lawyer and pay him to read over your contract, the one you made for your girls and the one for the photographer and he will tell you what exactly you can and cant do with them.

One more thing. It would help if you have the smallest amount of experience in this field before you try to manage 5 people in it

Ok i lied this is the last thing, i am not trying to be insulting or rude. But point blank, these girls are counting on you to help them, right now you are screwing them over, bad.

He can still read it if he wants to. My guess is that right about now he's either moving to OMP or he's embroiled in a Contact-A-Mod arguement.

Well, since you are here in TX and looks like you're trying to be a model "manager" or "agent" I do hope you have a license for it first.  You will need one in order to do this legally in the state of TX.
