Not unless the photog signed a "work for hire" contract. The creator it the holder of the copyright otherwise.

I've got a photo of one in my profile, but it wasn't the focus of the shoot or my intent.

I've been berated up and down by some photographer for that images vulgarity (check my profile, it's b&w, you can't miss it) but somehow it manages to be my most viewed image.

Funny sidenote, the shoot was part of a gift for the models bf (very intense BDSM couple).  They're married now and an 8x10 of it now hangs on their bedroom wall.
