Will someone explain to me exactly WHICH rights are being trampled on? I read this all the time in posts but it is always a general "Bush sucks!" type of remark without any statement as to WHY he sucks. Again, not trying to be mean, but this is really starting to tick me off.

Granted, I'm not the biggest Bush fan on the planet, but I don't see how they are crushing your liberties in regards to the 2257 changes. Not much has changed as Ty Simone pointed out and frankly some of it is a good idea. If you are shooting porn, you shouldn't be so ashamed of it that you have a problem with putting your real name on it. All the government wants to do is keep track of where this stuff is coming from. What's so bad about that? If a pornographer coaxes my daughter to be in a "fashion shoot" where they bait and switch and ask her to strip naked and abuse her, I'd definately want the attorney general to quickly take action. Like most laws, this isn't targeted at those who are following the law. This is meant to catch bad guys... Nobody will come after you unless you are using someone that obviously looks under the age of 18 or you are shooting extreme videos (use your imagination, I don't see a reason to define "extreme").

The danger of course is that using overly broad laws,language,interpretation on creeps is easy.  No one, but no one is going to stand up for the rights of child pornographers.  Many people react to the revised USC 2257 with a shrug and a flip of the head saying, so what, I'm not a child pornographer, I'll keep some records what's the big fucking deal?

The problem with 2257 lies (for me) in several places.  For one, the person laying down supplemental regulations interpreting 2257 is AG Gonzalez.  The same guy who advised the CIA on acceptable torture techniques.  He's already demonstrated that he's going to push interpretation of 2257 more broadly rather than narrowly. 

So what's the problem in that you ask?  Well there is this phenomena known as "chilling effect."  What that means is that humans, responding to fear, or wanting to avoid the hassle of governmental investigation, harassment, litigation,etc just decide to close shop.  You will likely see a number of sites shutting down.  This can affect the blogosphere (where teens actually blog about their lives), can be Yahoo groups, etc.  It can mean that out of fear of enforcement, people become uber censors and start prohibiting all sorts of content, like what happened on Ebay when they shut down an auction for BREAST CANCER SUPPORT and the auction was pulled because the pin that was up for auction actually showed a bare breast!

Whatever you do, don't believe that 2257 is the worst of it.  The reality is that much of this is laying the groundwork for what the DOJ really wants which is  "Mandatory Data Retention," which basically means that ALL ISPS will have to keep files on everything that people using their services are doing online--as in your emails, chatlogs, websites you visited, etc. I'm not kidding, this was floated by the neofascists at DOJ this year and you can read about it at CNET:

If folks don't see big brother having access to everything you do electronically then I'm not sure what it says for the State of the Union.

Reselling content will be interesting...since personal records, real names, IDs move with the content.  So let's say, model 1, who likes me, trusts me, works with me to shoot some adult erotica, and under the release, have the right to sell it.   I sell it to a tateful site "erotica for adults." They now have ID, address, real name in their records.  Now let's say "erotica for adults" goes under and sells it's content to "sleezeballs are us," a creepy outfit run by perv of the world....  Mr Perv webmaster now has access to models ID, address, etc.  So, it seems to me that some extra consideration is going to have to be made to ensure content /info stays in the right hands.

With all the rampant discussions of models needing escorts and feeling safe from pervy photographers, I would imagine that this issue would be commanding a bit more attention than it has......

Exactly right...for a recent example of the chilling effect remember last week when yahoo shut down ALL of its user created chat rooms because some people create rooms with improper subject matter in the names (child porn etc)? The answer would be to just shut down THOSE rooms, but yahoo shut everything down. You are correct the ultimate goal is to make ISP's responsible for EVERYTHING on their servers and that means everyone who uses hotmail or yahoo mail, well they will be required to read it/scan it to make sure nothing improper is in them. After that well, what about regular letters and snail mail..will the post office get the rights or actually be given the RESPONSIBILITY of randomly screening letters or packages?
