Hello,
    I've been working mostly with artistic photographers who pay me outright for nude shoots.  I had this request from a professional photographer and I don't know whether to take it seriously/believe him or not... 
"Well there would be no pay unless they want to use you. We are doing a submission shoot so we would need to do the shoot first, submit them and see if they like you.  If they do decide to use you then you would make about $1200.00 for the shoot."

Is it normal to do a "full spread" shoot for free??

If it's a professional photographer, ask for references.  That'll answer your question.  Or was it a photographer on Craigslist?  Because that's what that sounds like.

I don't have any direct experience with this, as it's not the genre I shoot.
But it seems plausible that Penthouse has some kind of "hometown hotties" submission, where if you are accepted that you are paid X dollars. So, I would guess there are photographers out there that are trying to capitalize on this and would give you some kind of percentage. I'd check out the photographers work, just like any other type of submission arrangement.

Possible.....I wouldn't bet on it.

Tell him you won't sign a release until they decide to use you. See what his reply is. wink

If the right person trips across your thread, you'd likely get a good answer from him.

It is my opinion, that the photographer is just trying to get a rather explicit set of nudes for free. In other words, I think he is playing you.  Given that Playboy, Penthouse, Hustler get hundreds of girls submitting photos hopping to be selected, his offer seems to be on the shady side.  If you want to do a nude Penthouse session for free, go ahead, but the chances of being accepted are miniscule.

Website and summit a few candids
If they like your look they will contact you

If its just a test for Penthouse, yes.
If they like you, they will hire you..
I've shot for penthouse...
But I would ask for references..
Its like a test for Playboy, only you show more but now. Playboy is showing more too..
Penthouse does pay their models good and they pay fast. My check was always in the mail and received within a month..

This is the single word that makes me question the entire offer.
When you are shooting for a submission where payment is involved upon acceptance, you generally know pretty specifically the details of that payment.  If there is a range of payment, then he should be able to give you that range.  If it's a set price, he should be able to say with confidence THIS amount.  "About" means he doesn't really know, or he's just making something up.  What is "about $1200" anyway?  $1000?  $2000?  $1204.28?  $0?

Smells fishy to me.

There is one guy in the Philly area who gets into Penthouse often.  If it is with him it sounds like a legit offer.  If it is just some guy who has never been published in the magazine before I'd be a bit careful.

Penthouse has their own group of photographers that they work with on a regular basis.

The magazine has recently undergone a change of ownership and has not done any production for about seven months.

They are just now starting back up with both the magazine and video production.

The model rates do vary, depending on what type of layout, how many pages, centerfold, second feature, special feature, etc.

If the photographer that has solicited the OP has a proven track record with Penthouse, then the offer may be legitimate.

Otherwise, I think it's just some guy with a camera looking to do a hot shoot with a fantasy of getting her in a magazine.

good advise. I would go with someone who have a good track record of getting published with new girls

or I would go with, pay me X amount.   If penthouse accept then subtract that from the $1200

Thanks everyone!  There are some great points here and lots of great advice.  I'm waiting to hear back from a model he's worked with in the past, but I'm probably going to go ahead with it.  He has gotten submissions accepted before and seems very professional.  I just wasn't sure if that's how Penthouse worked.  It seems like it does, though, and I wouldn't mind doing a very crisp, sexy shoot like this, anyway.  My experience so far has been all very natural artistic shoots, which I love, but I'd also like to do something a little different for a change.

Be aware that Penthouse is more than just 'spreads'.

The images that are published in the magazine are rather tame compared to the more explicit ones that are required.

The explicit ones go on the Penthouse website, which is where they make their money.

If you are not aware of what they show, you should do a little research so you aren't surprised during the shoot when asked to do things you might not have been prepared for.

They mostly cast porn models . . .

Penthouse doesn't use unsolicited shoots. It's not Suicide Girls. Even when Guccione was in charge nothing happened unless it was on purpose.

Sounds like you've got a scammer trying to be clever. If anything he probably wants to submit the photos to one of the gonzo mags or something underground where they'll take whatever they can get.

Many people throw out the term "magazine submission" as a way to avoid the standard agreements and protections between models, photographers, and clients. 

Unless the photographer has proven publication history with the magazine, you can get a contract to only use the photos as specified, and you are exactly the type of model that is usually published in the magazine-then this is probably not a good offer for you.  The offer is clearly more of a porn rather than art shoot and you may loose control over the use of the photos.

Not signing a release won't prevent him from selling the images. In florida which is my case, and most of the US (federal law), a photographer can sell the images without a model release unless the model is a minor. A release is only needed when publishing the photos. A lot of people misunderstand this, and most do not read the fine print of the law. I you don't want anything like that out there, don't shoot it. A photographer may sell the images to whoever he pleases to. If your not completely comfortable with it, chances are don't do it. If he doesn't have publications or professional model references, thats another red flag. Ive shot nudes before for submissions without pay, but I have models who vouch for me, and I my image is my reputation, so I don't sell anything without a models consent. 

Anyways, without work to show that is up to their magazine quality, I wouldn't bet on it either.

This may or may not but you could try contacting the magazine directly in seeing if the photographer in question has any sort of track record with working with the magazine.

OP - I've been published in Playboy (see my Profile page) so would you shoot with me?

The correct answer would be 'that depends'.

It would depend on my chances of getting you published in Playboy or Penthouse or whatever publication to whom I claimed I'd be submitting.

And the answer in my case would be slim to no chance! smile I don't have an in with such people - my image just got picked up. So the bottom line is 'do your homework'. First question I'd ask is 'can you show me your tear sheets (evidence of publication) for Penthouse (or any such publication)' and see what he comes back with.

Please do come back and tell us how it worked out.

I worked for Penthouse shoots (creating background sets) back in the day for the featured models, and my GF pay was $10,000 as a Centerfold, I also worked for Playboy as an Executive Asst., (and yes, dated more centerfolds) ~ so this info comes from direct knowledge, the pay is higher than you may initially imagine (High publication sales)

One, you would need to sign a contract, ask the photographer for a copy (both of you would have to sign) AND contact the magazines Submission Dept Director and ask for the full scoop. (they may also refer you to a web page with the information)

I currently also work in the publishing industry creating cover/intr Art, etc.  And its true that I don't get paid until an image is "chosen" for publication in most cases unless commissioned ~ which can be a lengthy process from months to a year before it goes to print.

soooo, contact the magazine and verify the info you were told = simple.

Exactly right, and the photographer who is asking our OP should know this is they have any history with the magazine.  I suspect this "offer" is perhaps wishful thinking on the part of the photographer , but who knows without more details.

Obviously no one gets paid if the magazine doesn't want to use it. Submissions like this are normal for some magazines.
But I don't recall a powerhouse branded magazine like Penthouse taking sets of photos from photographers who they haven't hired, but I don't know much about the way Penthouse runs. Ask him if he's worked for them before and references.

This looks like a scam to get free explicit nude photos of you.

   Certainly do not sign any rights away unless your given the amount of cash that was proposed to you, if the submission is accepted by the publication.

   You, the model should be compensated whether or not the submission is accepted by the publication or not. The compensation will vary greatly depending on whether or not the submission is accepted, but at the very least, in the case of a submission that is declined by the publication, the wording of your contract with the photographer should be such that the shoot reverts to a TFP where you get X number of edited photos from the shoot and the photographer can use the photos for their portfolio only or a modestly compensated for private shoot without any publishing rights at all being transferred to the photographer.

Curious that this thread should show up just now.  I also just received a message from a Philly region photographer regarding a Penthouse shoot.  I haven't gotten into discussing details with him, yet, but I would bet it's the same person.

Is it "outing" to use his name/id number if we aren't trash talking?  I'd like to know if we're all talking about the same person...

If this guy doesn't already have Penthouse tearsheets in his port, he's probably full of shit. Penthouse is a big name, and they don't work with just anyone. Also, they use a certain type of looks for their mag, and a model who doesn't fit that look isn't going to be accepted, no matter how beautiful she may be. OP, I didn't look at your port, but be aware of asking yourself if you look like the kind of girls who are published in Penthouse, and does this dude show signs of having worked for that publication before. If the answer to one or both those things is "eh, not really," then that's probably your answer.

I've kind of found out that people will do almost anything sometimes to convince models to shoot explicit material, without paying rates for that type of work. It's not like shooting art nudes; a lot of people want to shoot it, but don't want to pay for it. Some of those people are genuinely manipulative and dishonest.

Why don't you call up Penthouse and see if this guy is a photographer they've worked with before.. Or google his name with Penthouse and see if he's ever had anything published in the magazine.

I see casting calls all the time on MM and Craigslist for "Playboy SUBMiSSIONS"… That is no different than when you taking or you having a friend take photographs to submit to the magazine via their web site.  All these photographers casting for "Playboy SUBMISSIONS" want is to do a nude shoot with a gullible model, none of them are ever people who've actually shot for the magazine.  They probably do submit them (once again no different then you doing it yourself), and on the very very off chance Playboy or in this case Penthouse, actually chooses you, instead of you getting the full amount if you'd submitted them yourself, the photographer will get a percentage as a finders fee.

Sounds like he says he wants to submit your photos, but doesn't already have any relationship with the company. You can submit your own photos directly. If they are interested in *you* they will set you up with a photo shoot. You don't need professional photos to get them interested in *you*

Submissions don't mean too much. IIRC most mags pay photographers a piece of whatever they pay for images they actually choose.. so if he is 100% certain he can get you in there should be no problem paying you. Otherwise they just have very explicit photos and all the rights and no cost. I think I saw someone suggest a clause in the release about not being able to use them for anything but Penthouse submissions? That sounds like a good idea.

Bottomline, for any magazine submission, they just need to see what you look like. You don't need professional photos, you can do it on your own which in most cases the preferred method. If they like you, they will setup a shoot or refer you to someone.

Another point to consider. If you shoot with this photographer and he submits to Penthouse. What do you think he's going to do with the photos if they decline? He's going to shop them around.
